POLICY 12: NON-DISCRIMINATION

12.1 Purpose

To affirm the commitment of Burdean Quality Caregivers LLC to non-discrimination

in all aspects of employment and service delivery in compliance with federal and

state civil rights laws.

12.2 Policy Statement

Burdean Quality Caregivers LLC does not discriminate against any individual on the

basis of race, color, national origin, religion, sex, sexual orientation, gender identity,

age, disability, genetic information, ancestry, veteran status, or any other

characteristic protected by federal, state, or local law.

12.3 Scope

This policy applies to all aspects of Agency operations, including:

• Participant services and access to services

• Employment, hiring, and promotion

• Training and professional development

• Compensation and benefits

• Discipline and termination

• Contractor and vendor relationships

12.4 Legal Framework

This policy is established in compliance with:

• Title VI of the Civil Rights Act of 1964

• Section 504 of the Rehabilitation Act of 1973

• Americans with Disabilities Act (ADA) of 1990

• Age Discrimination Act of 1975

• Section 1557 of the Affordable Care Act

• Pennsylvania Human Relations Act

• Philadelphia Fair Practices Ordinance

12.5 Prohibited Conduct

The following conduct is prohibited:

• Denying services or employment based on protected characteristics

• Providing different or inferior services based on protected characteristics

• Harassment based on protected characteristics

• Retaliation against individuals who report discrimination or participate in

investigations

• Segregating participants or employees based on protected characteristics

12.6 Complaint Procedure

Any individual who believes they have been subjected to discrimination may file a

complaint with the Agency Administrator. Complaints will be investigated promptly

and confidentially. The Agency prohibits retaliation against anyone who files a

complaint or participates in an investigation.

12.7 External Reporting

Individuals may also file complaints with:

• Office for Civil Rights, U.S. Department of Health and Human Services

• Pennsylvania Human Relations Commission

• Philadelphia Commission on Human Relations

12.8 Training

All employees receive non-discrimination training at hire and annually thereafter.
